1. Who we are
DelayDHD ("the Service", "we", "us") is operated by Rebecca-kay Francis ("the Seller"). By using the Service, you ("the User") are entering into a contract with the Seller.
2. Acceptance
By accessing or using DelayDHD, you agree to be bound by these Terms. If you do not agree, do not use the Service. Your continued use of the Service constitutes acceptance of any updates to these Terms.
3. The Service
DelayDHD is a web-based task management and brain-dump tool designed for people with ADHD. Plans, limits, and features are described on our Pricing page.
4. Eligibility & account
You must be of legal age in your jurisdiction (or have parental consent) to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must provide accurate information and keep it up to date.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use the Service for any unlawful purpose, fraud, or spam.
- Infringe the intellectual property rights of any third party.
- Interfere with the security or integrity of the Service (including malware, probing, or scraping).
- Attempt to reverse engineer, resell, or redistribute the Service.
- Circumvent any technical limits, rate limits, or access controls.
6. Intellectual property
The Seller retains all right, title, and interest in and to the Service, including the software, documentation, branding, and any related intellectual property. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.
7. User content
You retain ownership of content you submit to the Service (such as tasks and brain dumps). You grant us a limited license to host and process your content solely for the purpose of providing the Service to you.
8. AI features
The Service includes AI-assisted features (chat, triage suggestions). You are responsible for your prompts and for how you use AI outputs. Outputs may be inaccurate and should not be relied upon for professional advice (medical, legal, financial, etc.) without your own verification. We may filter, refuse, or moderate outputs, and may suspend accounts that submit prohibited content (illegal material, hate speech, harassment, attempts to jailbreak the system, malware, deepfakes).
9. Service level
We work hard to keep the Service available but do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Payments, billing & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms and our Refund Policy.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time and retain access until the end of the current period.
11. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. On termination, you may export your data within a reasonable window before it is deleted.
12. Liability
To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where this cannot lawfully be excluded.
13. Indemnity
You agree to indemnify us against any claims arising from your user content, your unlawful use of the Service, or your breach of these Terms.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service. Your continued use after a change constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Seller's jurisdiction. Disputes will be resolved in the courts of that jurisdiction unless otherwise required by applicable consumer-protection law.
